By using the service you agree to these terms. If you do not agree, do not use the service.

1. Who we are

Insta Quote AI is an AI quoting system built to help trade, building and supply businesses price work faster and more consistently. The service is delivered through our mobile app and our web app.

We do not guarantee accuracy, earnings or outcomes.

2. How the service works

Insta Quote AI is a subscription service. After you subscribe, our team contacts you directly to set up your account, configure your quoting structure and tailor the system to your trade and your pricing.

Once your system is set up you access it through the Insta Quote AI mobile app and web app.

3. Eligibility and accounts

You must have the legal authority to enter into these terms on your own behalf or on behalf of your business.

You are responsible for:

• keeping your login details secure;
• all activity on your account;
• telling us straight away about any unauthorised use.

If you add team members to your account, you are responsible for making sure they follow these terms.

4. AI output, accuracy and your responsibility

No guarantee of accuracy

AI can make mistakes. It can misread a photo or a drawing, invent detail, miscalculate, or produce information that is wrong. You acknowledge and accept this.

Review is mandatory

Every quote, estimate, scope and job document produced with Insta Quote AI must be reviewed and approved by you before you send it or rely on it.

No reliance without checking

You must check:

• quantities;
• labour hours;
• material lists;
• pricing and margins;
• GST;
• compliance with legal and building rules.

AI output is a draft, not a final quote.

Not professional advice

We do not provide financial, legal, accounting, engineering or safety advice.

AI processing and third party data sharing

To generate your quotes, Insta Quote AI sends the information you provide for a quote, which includes job descriptions, measurements, client details you enter and any photos or plans you upload, to our AI processing provider. That provider processes the information solely to generate the quote we return to you. Your data is not used to train their models, and it is given protections consistent with our privacy policy. We do not sell your personal information.

We ask for your consent inside the app before any of this information is sent to the AI for the first time.

5. Custom feature requests

Subscribers can request additional features, functionality or customisations. You acknowledge and agree that:

• custom feature requests are considered case by case;
• we are under no obligation to build, implement or deliver any requested feature;
• any indication that a feature may be added is not a guarantee or a commitment;
• no refund or compensation is issued if a requested feature is not delivered;
• features may be added, changed or removed at our discretion at any time.

We welcome feedback and feature suggestions and we will do our best to improve the service over time, but this stays at our discretion.

6. No earnings guarantees, and no responsibility for business outcomes

No promises about revenue or performance

We do not guarantee increased profit, better quoting results, more jobs won, financial improvement, time savings or win rate improvements.

Any statistics or estimates referenced on our website or in our marketing are indicative only and based on general estimates. Individual results will vary.

Your decisions are your responsibility

You are fully responsible for your pricing and margins, the jobs you accept or decline, the materials you order, your business performance, and the consequences of the quotes you create and send.

No liability for losses

To the greatest extent allowed by law, we are not liable for financial loss, underquoting or overquoting, lost profit or revenue, lost contracts or customers, or mistakes caused by AI output.

7. We are not responsible for inaccurate quotes

Every quote created with Insta Quote AI is your quote. We are not responsible for inaccuracies caused by AI output, incorrect inputs from you or your team, misread photos, plans or descriptions, cost changes in materials or labour, or GST and tax miscalculations.

You must validate everything before a quote goes to a client.

8. Subscriptions and refunds

Payments

Subscriptions are processed through third party payment providers. By subscribing you authorise recurring charges at the agreed subscription rate.

Renewals

Subscriptions renew automatically each month unless cancelled before the next billing date.

Onboarding

After you subscribe, our team reaches out to begin your account and quoting structure setup. You agree to give us accurate information during that process so the system works correctly for your trade.

No refund policy

To the maximum extent allowed by law, all purchases, subscriptions and renewals are non-refundable. No refunds are issued for dissatisfaction with AI output, custom feature requests that are not delivered, accidental purchases, forgetting to cancel, unused subscription time, platform performance issues, or delays in onboarding caused by a failure to respond or provide information.

This does not override non-excludable consumer rights under New Zealand or Australian law where they apply.

9. Acceptable use

You agree not to break the law, generate fraudulent or misleading quotes, upload viruses or harmful code, reverse engineer or bypass security, share your account access with unauthorised users outside approved team member seats, or overload, interfere with or abuse the service.

We may suspend or terminate access if the service is misused.

10. Team members

Your subscription may include the ability to add team members who use the service on their own login against your quoting structure. You are responsible for all activity by team members on your account, for making sure they follow these terms, and for removing their access when it is no longer needed.

11. Ownership and licence

We own all intellectual property in the app, the software, the AI, the branding and the content, except your content. You own your job data, your photos and your customer details.

You give us permission to process your information to provide the service, maintain functionality, improve quoting accuracy, and comply with the law.

12. Service availability and changes

We do not guarantee uninterrupted uptime, error free operation, or that any feature stays available permanently. We may update, remove or modify features at any time, and we will do our best to communicate significant changes.

13. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special or consequential damages, lost profit, revenue, goodwill or opportunities, inaccuracies in AI output, decisions you make using quotes generated by the service, or a failure to deliver custom features.

Where liability cannot be excluded, it is limited to the amount you paid in the preceding three months.

14. Indemnity

You agree to indemnify Insta Quote Ltd against all claims and losses arising from your use of the service, the quotes you produce and send, your content, your legal breaches, and activity by team members on your account.

15. Governing law

These terms are governed by New Zealand law. You agree to the non-exclusive jurisdiction of the New Zealand courts.

16. Changes to these terms

We may update these terms at any time. Continued use of the service means you accept the updated version.
